Short answer: For most Lake Wylie and River Hills addresses, York County Permit Services. The county issues building permits in the unincorporated parts of York County, and says a permit is required to construct, enlarge, alter, repair, move or demolish a building, or to install, alter, repair or replace electrical, gas, mechanical or plumbing systems. Inside River Hills there is a second, separate approval: the River Hills Community Association issues its own permits for work on the house, driveway, walkway or landscape, and sends larger requests to its Architectural Review Committee. You need both.
Why people get this wrong
Lake Wylie has a Clover or Lake Wylie mailing address, sits next to Charlotte and shares a lake with North Carolina, so people call the wrong office. Unless your parcel is inside a town's limits, the county is the permitting office. York County says to use its GIS map to confirm which jurisdiction your property is in; do that before you apply.
In River Hills the second mistake is thinking the Community Association approval is the permit, or the other way round. They are two different things: the county checks the work against the building code, and the Association checks it against the community's own rules.
What York County requires
- When you need a permit. To construct, enlarge, alter, repair, move, demolish or change the use of a building, or to install, alter, repair, remove, convert or replace electrical, gas, mechanical or plumbing systems.
- Trade permits. A mechanical, electrical, plumbing or gas permit needs the application with the job cost.
- Additions and renovations. The county's addition and renovation packet asks for plans, a plat with setbacks, and an HOA approval letter if required, on the association's letterhead and signed.
- Contractors. The county requires every contractor to be licensed through SC LLR. Ours is general contractor licence CLG.127339.
- Review time. Once the application is accepted, the county asks you to allow 5 to 7 business days, and it contacts you when the permit is ready. Inspections are booked online or by calling Permit Services at 803-909-7200.
Doing it yourself (owner-builder)
York County allows a homeowner to act as the contractor. For trade permits the county asks for an Owner's Disclosure. For an addition or renovation it says the Owner's Disclosure Statement must be signed, notarized and registered with the property deed at the Register of Deeds Office. Anyone you hire still has to be licensed. For small jobs that do not change structure or systems, you may not need a contractor at all.
River Hills: the second approval
The River Hills Community Association says that to remove, replace or improve your house, driveway, walkway or landscape, you must file for a permit with the Association. Depending on the work, the office may issue it, or for more significant requests the Architectural Review Committee (ARC) must review and approve it. ARC applications are at the RHCA office or on riverhills.com, and the deadline and review schedule is printed monthly in the River Hills "Neighbor". If the ARC objects, you can revise the application or appeal to the HOA Board. The RHCA office is 803-831-8214.
Get the Association approval early: where the county asks for an HOA letter, it cannot finish its review without one.
When it is serious
- Work already started without a permit, or a past owner's unpermitted addition or finished basement: talk to the county before you sell or build on top of it.
- Trees near the water. River Hills requires its own permit to remove most trees. If the tree is in the 50-foot buffer York County set around Lake Wylie, the Association says you also need a permit from York County and/or Duke Power.
What is left after the trade fix
On a Lake Wylie remodel, the licensed trades pull their own trade permits. Someone still has to get the Association approval, put the county application together with the HOA letter, answer plan-review comments, run the inspections in order and close the job out.
